The Tobacco and Primary Medical Services Act 2010 allow West Dunbartonshire Council to issue fixed penalty notices for offences and to apply to the Sheriff Court for a tobacco/Nicotine Vaping Products (Vapes) banning order to restrict premises and or individuals from the sale or supply of tobacco or vapes for a period of time.
Shops which sell tobacco or vapes must be registered with the Scottish Government to do so and have certain legal requirements placed upon them, they must only have tobacco behind an enclosed gantry and display certain signage. Vapes and tobacco products contain nicotine, which is a highly addictive substance. The legal age for buying vapes and tobacco in Scotland is 18 years. Anyone who sells these to persons under this age, commits an offence. Anyone who fails to operate a Challenge 25 Age Verification Policy regarding the sale of vapes also commits an offence.
Whilst the majority of retail businesses comply with the law Trading Standards will take proportionate enforcement action where this is required. Below is a list of banning orders that have been issued by Dumbarton Sheriff Court which restrict the sale of tobacco an or vapes.
