West Dunbartonshire Council as Harbour Authority under Section 252 of the Merchant Shipping Act 1995
Notice is hereby given that on [23rd May 2024] West Dunbartonshire Council made an Order under Section 252 of the Merchant Shipping Act 1995 (“the 1995 Act”) to exercise it powers as harbour authority of Leven Harbour to remove the vessels ( the “vessels” ) described in the Schedule to this order from Leven Harbour, Dumbarton; the vessels are abandoned in Leven Harbour under the control of West Dunbartonshire Council as harbour authority (the “harbour authority”), and in the opinion of the harbour authority the vessels are an obstruction or danger to navigation in the Leven Harbour or water or approach thereto.
Further the harbour authority will exercise its powers under the 1995 Act to sell or dispose of such vessels, in such manner as the harbour authority think fit, and reimburse themselves, out of the proceeds of the sale (if any), for the expenses incurred by them in relation to the removal and sale.
A copy of the Order and relevant plan showing the vessels can also be viewed at the Council Offices, 16 Church Street, Dumbarton, G82 1QL. Any person may, within 28 days from the date of publication of this notice, make representations or object to the making of the Order, quoting reference [HARBOUR NOTICE 1/2024]. Representations and objections should be submitted either by email to RoadsPermits@west-dunbarton.gov.uk or in writing by post to Roads and Transportation , West Dunbartonshire Council, 16 Church Street, Dumbarton, G82 1QL and should include the name and address of the person by whom they are made, the matters to which they relate and the grounds on which they are made.
